These terms are an agreement between you and Mobility Arts (Mengmeng Zhang) ("we", "us") about your use of the Kyimolung app. By installing or using the app you accept them. Apple's Licensed Application End User License Agreement also applies; where the two conflict, these terms prevail to the extent Apple's agreement allows.

What Kyimolung is — and isn't

Kyimolung generates adaptive soundscapes and visuals intended to support focus, relaxation, sleep and movement. It is a wellness and entertainment product. It is not a medical device, does not diagnose, treat or prevent any condition, and is not a substitute for professional medical advice. If you have a health concern — including epilepsy or photosensitivity, a heart condition, or a hearing condition — consult a professional before using audio entrainment or animated visuals. Do not use the app while driving or operating machinery, and keep the volume at a comfortable level; prolonged loud listening can damage hearing.

Your licence

We grant you a personal, non-transferable, non-exclusive licence to use the app on Apple devices you own or control, as permitted by the App Store's usage rules. The app, its sounds, visuals, names and code are our property or used under licence, and are protected by copyright and other laws. You may not copy, modify, distribute, sell, reverse-engineer or extract the app or its content, except as the law expressly permits.

Premium, subscriptions and purchases

Some content is part of Kyimolung Premium. Premium can be earned for free by keeping listening streaks, or purchased:

Prices are shown in your local currency in the app and may vary by region; taxes may apply. All purchases are processed by Apple, and refunds are handled by Apple under its refund policy. Purchases can be restored on your other devices with the "Restore purchases" button. The free earning path may change over time; content earned or purchased remains available in the app while it is offered.

Screen Time focus shield

The optional focus shield blocks apps you select during a listening session using Apple's Screen Time technology. You control it entirely: pausing the session, turning the shield off or restarting the app lifts it. It is a personal focus tool, not a parental-control or security product, and we make no guarantee that it cannot be bypassed.

Your data

How the app handles data is described in the Privacy Policy, which forms part of these terms. In short: no accounts, no servers, no collection.

Acceptable use

Use the app lawfully and for its intended purpose. Do not attempt to interfere with, exploit or circumvent the app, the App Store or the purchase system.

Availability and changes

We may update, change or discontinue features, soundscapes or the app itself. We will give reasonable notice of any change that materially affects a paid purchase where the law or the App Store requires it. These terms may be updated; the effective date at the top will change and the new terms will apply to your continued use.

Disclaimer and liability

To the fullest extent permitted by law, the app is provided "as is" without warranties of any kind, and we are not liable for indirect, incidental or consequential loss arising from its use. Nothing in these terms excludes rights you have under the Australian Consumer Law or other consumer protection laws that cannot be excluded; where liability cannot be excluded, it is limited, at our option, to re-supplying the service or the cost of doing so. Apple is not responsible for the app or for any claim relating to it, as set out in Apple's agreement above.

Governing law

These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts — without affecting any mandatory consumer rights in your country of residence.
